A person must use a trustee in bankruptcy when he or she goes into bankruptcy or files a consumer or Division I proposal. Canadian Bankruptcy and Insolvency Lawyers also have a part to play in the process especially if there are significant assets at stake.
Here are some situations where a debtor might want to use a Canadian Bankruptcy and Insolvency Lawyer:
There are very significant assets involved;
You are filing bankruptcy or a proposal but your spouse is not and he has significant assets, on which he wants independent legal advice;
Your business is filing a proposal and you want independent legal advice;
Your discharge from bankruptcy has been opposed and you want legal representation;
You filed bankruptcy but your student loans were not erased. You now wish to make a "hardship" application to count to have your student loans erased.
