Jacki: She can file bankruptcy and the student loans will be included in the bankruptcy since it has been more than 7 years since she was in school.

Mike: What your options are with the leased furniture will depend on the contract you signed. Take the contract to the trustee for your initial consultation and he will be able to tell you your options.

My daughter had been paying her student loans(from 2002? 1 federal 1 provincial)) until three years ago. She was crossing the street one night and was struck by a car. She has not worked since and is waiting for her 4th surgery. Any money she recieves(SAAQ) goes towards her recovery. (Physio, message therapy etc) Is she able to declare bankruptcy? We live in Quebec so she can not sue the driver due to the no fault laws. (no one is responsible) No lawsuit =no settlement.

Thank you for having this website.

I am considering bankruptcy, but have a question first.
I understand that you can keep household furnishings, however what is not clear to me is this, What if it is leased furniture?
I currently have a home that is furnished with easy home items, most are almost paid off but am now having trouble keeping up with the high payments.
Can I use easy home in the bankruptcy? or will all the items need to be sent back?

Mary: What she has told you about her not being able to pay you is correct. The discharge term varies with the income of bankrupt. Please refer to:

My daughter declared bankruptcy in Vancouver and she owns me money. She has told me that she cannot pay me as that will affect her discharge. Is that true? she says her discharge is in 21 months and I noticed this website says it is 9 months. What is the correct time?
